Purpose and subject of procurement:
The subject of the agreement is the supply of Hygiene Kits with marking, at the address: Ukraine, Kyiv region, Brovary district. Within the Kyiv region - the delivery of goods to the warehouse will be covered by the Charitable Organization National Network of Local Philanthropy Development, in other cases, the delivery price should be included in the cost of the goods. The purpose of the procurement is a Humanitarian Kit with marking for further distribution to people affected in result of the war in Ukraine.
Quantity, nomenclature, assortment, and requirements for the subject of procurement are specified in Appendix 1 to the tender documentation "Technical Specification".

Information about the currency in which the tender proposal should be calculated and indicated:
The currency of the tender proposal is the hryvnia. The bid price should be calculated and indicated in UAH.
Settlements will be made in the national currency of Ukraine in accordance with the terms of the concluded agreement.
The price of the tender proposal of the tenderer means the amount in UAH for which the tenderer provides goods for the sale.
The bid price should be determined taking into account all taxes, fees, and mandatory payments.
Information on the language(s) that should be used to create the tender proposals:
Documents as part of the tender proposal must be drawn up by the tenderers in two copies in Ukrainian and English.
The Tenderer shall provide the Organization with the following documents:
1. A copy of the document confirming the state registration;
2. A copy of the document confirming the tax status;
3. Quality certificates for goods included in the "Hygiene Kit";

Unusual business expenses:
Tender proposals will be rejected or agreements terminated if it is found that the award or performance of the agreement resulted in unusual commercial costs. Such unusual commercial expenses are commissions not specified in the main agreement or not arising from a duly concluded agreement that refers to the main agreement, commissions not paid in exchange for any actual and legitimate services, commissions transferred to tax offshores, commissions paid to the recipient who is not clearly identified, or commissions paid to a company that looks like a shell company.

Price offers are accepted until 23:59 hours 25.09.2023. Proposals sent after the specified period will be deemed invalid and will not be considered.
Due to the fact that the communication load of our organization is quite large, we may not send confirmation of receipt of tender documents.
Suppliers/sellers bear all the costs associated with the preparation and provision of the proposal, while CO "National Network of Local Philanthropy Development" in no case is responsible for these costs, regardless of the process or result of engagement to cooperation.
CO "National Network of Local Philanthropy Development" may reject any request that does not essentially meet the query conditions for a commercial offer.
CO "National Network of Local Philanthropy Development" is not obliged to accept the lowest or any offer and reserves the right to accept any offer without explanation and to sign agreement on any terms offered or otherwise.
CO "National Network of Local Philanthropy Development" reserves the right to change or cancel the requirements at any time during the process of sending a request for commercial offer and/or engagement to cooperation.
CO "National Network of Local Philanthropy Development" also reserves the right to require the fulfillment of additional conditions each time the organization draws up final agreements.
Tender procedures and stages of the tender:
Tender proposals that fully comply with the terms of this Tender Announcement are allowed to participate in the Tender Procedure.
Stages and their terms during the tender:
1. Announcement of the tender dated 04.09.2023.
2. Collection of Tendered proposals within 21 days until 23:59 25.09.2023.
3. Analysis and evaluation of tender proposals within 3 work days until 23:59 28.09.2023.
4. Announcement of results of tender proposals evaluation - 29.09.2023.
5. Interview with the three best offers within 3 work days from 02.10.2023 to 04.10.2023 *.
6. Analysis and evaluation of tender proposals based on the results of the interviews - 05.10.2023.
7. Announcement of the results of the interviews - 06.10.2023.
8. Negotiating of the agreement with the winner within 2 days from 07.10.2023 to 08.10.2023.
9. Signing the agreement with the winner - 09.10.2023.
* - After the first stage of the tender, namely the evaluation of tender proposals, the CO "National Network of Local Philanthropy Development" on the basis of the results obtained among the 3 (three) best proposals conducts the second stage of selection in the format of an interview and evaluation of a test sample of the "Hygiene Kit"
The main criteria (conditions) for the selection of tender proposals:
1. Tenderer's compliance with the Tender Announcement requirements;
2. Compliance of the submitted documents with the terms of the Tender Announcement;
3. Compliance with the expectations of the Organization regarding the composition of the kit;
4. Ability to deliver goods with a minimum shelf life of eight months from delivery date.
5. Terms of payment.
6. Price of supply of goods/works/services for humanitarian kit for 1 piece.
7. Price of supply of goods/works/services for marking "Hygiene kit" for 1 piece.
8. Delivery time, and deadline for delivery of all goods/works/services.
An important condition is the use in Hygiene Kits of goods and services produced only by Ukrainian manufacturers.
The tenderer determines the prices for the goods that he proposes to deliver under the procurement agreement, taking into account taxes and fees (including value-added tax (VAT), if the tenderer is a VAT payer), paid or to be paid, all other costs provided for the goods of this type.

Contracting:
The winner of the tender will be contracted with the CO "National Network of Local Philanthropy Development".
Ethical provisions and code of conduct:
No conflict of interest
The tenderer shall not have any conflict of interest and shall not have an equivalent relationship in this regard with other tenderers or parties involved in the project. Any attempt by a tenderer to obtain confidential information, enter into unlawful agreements with competitors, or influence the evaluation commission will lead to the rejection of his proposal.
Respect for human rights as well as environmental legislation and basic labor standards
The tenderer and its staff must comply with human rights and applicable data protection regulations. In particular, under the basic act in force, tenderers and applicants who have been awarded contracts must comply with environmental legislation, including multilateral environmental agreements, as well as basic labor standards, if applicable and defined in relevant International Labour Organisation conventions (such as freedom of association and collective bargaining conventions; elimination of forced and compulsory labor; abolition of child labor).
Zero tolerance for sexual exploitation, violence, and harassment: CO "National Network of Local Philanthropy Development" applies a "zero tolerance" policy to any illegal behavior that affects the professional trust of the tenderer. Physical violence or punishment, threats of physical violence, sexual violence or exploitation, harassment and verbal abuse, and other forms of intimidation are prohibited.
Fighting corruption, bribery, and avoiding sanctions against companies and countries of origin of goods:
The tenderer shall comply with all applicable anti-bribery and anti-corruption laws, regulations, and codes.
In accordance with the Law of Ukraine dated 06.12.2019 No. 361-IX
On prevention and counteraction to legalization (laundering) of proceeds from crime, financing of terrorism, and financing of proliferation of weapons of mass destruction.
The tenderer, manufacturers of supplied goods, and all other involved contractors should not be subject to sanctions imposed in Ukraine and abroad, and must also meet the requirements of state policy in the field of combating money laundering to the level of final beneficiaries.
